Terms of Service

By accessing or using FloraMind, you confirm that you are at least 13 years of age (or the applicable minimum age of digital consent in your jurisdiction), that you have the legal capacity to enter into a binding agreement, and that you accept these Terms in full.

If you are using the Application on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms, and the term “you” refers to that organisation.

Use of the Application is also subject to our Privacy Policy, which is incorporated into these Terms by reference.

FloraMind is a plant care application for iOS and Android that allows you to:

• Track houseplants and manage care schedules (watering, fertilising, repotting)
• Receive local on-device reminders for upcoming care tasks
• Log care history and maintain a growth photo journal
• Submit plant photographs for AI-assisted identification and health diagnosis
• Optionally sync your plant library across devices via a registered account

Core functionality is available offline without registration. Cloud synchronisation and AI identification features require an internet connection and, in the case of synchronisation, a registered account.

We reserve the right to modify, suspend, or discontinue any feature or the Application as a whole at any time. Where a change materially affects paid features, we will provide reasonable advance notice to affected users.

To access cloud synchronisation you must register an account using a valid email address and a password. You are responsible for:

• Providing accurate and current registration information
• Keeping your password confidential and not sharing account credentials
• All activity that occurs under your account
• Notifying us promptly at cucereanumdev@gmail.com if you become aware of any unauthorised use

We reserve the right to suspend or terminate accounts that are found to be in violation of these Terms, to be associated with abusive behaviour, or to pose a security risk to other users or our infrastructure.

You may delete your account at any time via Settings → Account → Delete Account. Account deletion removes your access immediately and permanently deletes server-side data within 30 days as described in our Privacy Policy.

You may use FloraMind without registering an account (“Guest Mode”). In Guest Mode, all data is stored exclusively on your device using local storage. We have no access to this data, and it is not backed up to our servers.

If you uninstall the Application while in Guest Mode, all locally stored data will be permanently lost. We are not liable for data loss resulting from uninstallation, device failure, or factory reset while using Guest Mode.

When you create a registered account on a device that already contains guest data, FloraMind will upload your local plant library to your new account. This migration is a one-time operation and cannot be undone.

“User Content” means any data, text, photographs, or other material you submit to the Application, including plant records, notes, care logs, and photographs you upload for identification or as part of your growth journal.

You retain full ownership of your User Content. By submitting User Content to the Application you grant FloraMind a limited, non-exclusive, royalty-free licence to store, process, and transmit that content solely to the extent necessary to provide the services described in these Terms — specifically, to synchronise your data across your authorised devices and to process identification photographs via our AI pipeline. This licence terminates when you delete the relevant content or your account.

You represent and warrant that:

• You own or have the necessary rights to the User Content you submit
• Your User Content does not infringe any third-party intellectual property, privacy, or other rights
• Your User Content does not contain material that is unlawful, harmful, or offensive

We do not review User Content before it is stored, and we are not responsible for the accuracy or legality of content you submit. We reserve the right to remove User Content that violates these Terms.

You agree not to use the Application to:

• Violate any applicable law or regulation
• Attempt to gain unauthorised access to our servers, infrastructure, or other users' accounts
• Reverse-engineer, decompile, or disassemble any part of the Application, except to the extent expressly permitted by applicable law
• Scrape, harvest, or otherwise extract data from the Application using automated means
• Use the Application in any manner that could damage, disable, overburden, or impair our servers or networks
• Submit photographs containing unlawful content for AI identification
• Circumvent any usage limits or access controls implemented in the Application

Violations of this section may result in immediate suspension or termination of your account and, where required, referral to law-enforcement authorities.

FloraMind may offer optional paid features or subscriptions (“Premium”) that unlock higher AI identification limits or additional functionality. All purchases are processed exclusively through the Apple App Store or Google Play. We do not collect or handle payment card information directly.

Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period. You can manage and cancel subscriptions at any time via your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period — you retain access to paid features until that date.

All prices are displayed in your local currency as determined by the App Store or Google Play. We reserve the right to change subscription pricing with reasonable advance notice. Price changes will not affect your current billing period.

Refunds are subject to Apple's and Google's refund policies. We do not process refunds directly. If you believe you are entitled to a refund, please contact Apple Support or Google Play Support.

The Application, including its design, code, graphics, and all content we produce, is owned by FloraMind and protected by copyright, trademark, and other intellectual property laws. These Terms do not transfer any intellectual property rights to you.

You are granted a limited, non-exclusive, non-transferable, revocable licence to install and use the Application on devices you own or control, solely for your personal, non-commercial purposes and in accordance with these Terms. This licence does not include the right to sublicence, modify, distribute, or create derivative works based on the Application.

The FloraMind name, logo, and any associated marks are trademarks of FloraMind. Nothing in these Terms grants you the right to use any of our trademarks without our prior written consent.

The Application uses the following third-party services:

• Google Gemini (Google LLC) — used server-side to process plant identification and health diagnosis requests. Your submitted photographs are transmitted to Google's infrastructure for this purpose. Google's use of data is governed by its own terms and privacy policy.
• Apple App Store / Google Play — used for application distribution and in-app purchase processing. These platforms operate under their own terms of service.

We are not responsible for the availability, accuracy, or practices of third-party services. Your use of those services is subject to their respective terms and privacy policies.

To the maximum extent permitted by applicable law:

The Application is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

AI identification and health diagnosis results are informational only. They are generated by an AI model and may be inaccurate. Do not rely on them as a substitute for advice from a qualified horticulturalist or botanist. FloraMind makes no warranty as to the accuracy or completeness of AI-generated results.

We do not warrant that the Application will be uninterrupted, error-free, or free from viruses or other harmful components. We do not warrant that any defects will be corrected or that the Application will meet your specific requirements.

Nothing in these Terms affects any statutory rights you may have as a consumer under applicable law that cannot be excluded or limited by contract.

To the maximum extent permitted by applicable law:

FloraMind and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, loss of plants (or plant health), or loss of goodwill, arising out of or in connection with your use of or inability to use the Application, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claims arising under or in connection with these Terms shall not exceed the amount you paid us (if any) in the twelve months preceding the event giving rise to the claim, or €10, whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

You may stop using the Application at any time. You may delete your account via Settings → Account → Delete Account. Uninstalling the Application removes all locally stored data from that device.

We may suspend or terminate your access to the Application at any time, with or without notice, if you violate these Terms, engage in behaviour that poses a risk to other users or our infrastructure, or if we are required to do so by law.

Upon termination, your licence to use the Application ceases immediately. Sections covering intellectual property, disclaimers, limitation of liability, and governing law survive termination of these Terms.

We reserve the right to update these Terms at any time. The effective date at the top of this page will reflect the date the current version took effect. We will always make the current Terms available within the Application and at this URL.

For material changes — such as changes to payment terms, limitations of liability, or your legal rights — we will provide at least 14 days’ advance notice via an in-app notification and, where you hold a registered account, by email. Your continued use of the Application after the revised Terms take effect constitutes acceptance of those changes.

If you do not agree to the revised Terms, you must stop using the Application and, if applicable, delete your account before the revised Terms take effect.

These Terms are governed by and construed in accordance with applicable law. If you are a consumer in the European Union, you benefit from any mandatory provisions of the law of your country of residence, and nothing in these Terms affects your rights as a consumer under that law.

If you are located in the EU, you may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr for disputes related to online purchases.

We will always attempt to resolve disputes amicably. Before initiating any formal proceedings, please contact us at cucereanumdev@gmail.com so we can try to address your concern directly.
